Welcome to ballcoach. By downloading, installing, or using our mobile application, you agree to be bound by these Terms of Service. Please read them carefully.

If you do not agree to these terms, do not download, install, or use the ballcoach application.

1. Acceptance of terms

By downloading, accessing, or using the ballcoach mobile application (the "App" or "Service"), you agree to be bound by:

• Our Privacy Policy (ballcoachai.com/privacy)
• Apple's App Store Terms of Service (for iOS users)
• Google Play Terms of Service (for Android users)

Age requirements

ballcoach is intended for users aged 16 years and older.

• If you are under 16, you may NOT use the App under any circumstances
• If you are between 16-18, you may use the App only with parental or legal guardian consent and supervision
• By using the App, you represent and warrant that you meet these age requirements

We reserve the right to request proof of age and parental consent at any time. Accounts that violate these age requirements will be terminated immediately.

2. What ballcoach is

ballcoach is an AI-powered training and performance assistant designed for football (soccer) players. It provides:

• Personalized training recommendations
• Performance tracking and analysis
• AI-powered coaching feedback
• Nutrition and recovery guidance
• Match preparation insights

ballcoach is a tool to support your training—it does not replace professional coaching, medical advice, or physical trainers.

3. Your account

When you create an account, you agree to:

• Provide accurate and complete information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Take responsibility for all activities under your account

You may not share your account with others or use someone else's account without permission.

4. Acceptable use

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to hack, reverse-engineer, or disrupt the Service
• Upload harmful content (viruses, malware, spam, etc.)
• Harass, abuse, or harm other users
• Scrape or extract data from the Service without permission
• Resell or redistribute the Service without authorization

We reserve the right to suspend or terminate accounts that violate these terms.

5. Content & intellectual property

Your content: You retain ownership of any training data, notes, or information you input into ballcoach. By using the Service, you grant us a license to use this data to provide and improve our features (as described in our Privacy Policy).

Our content: All text, graphics, code, design, AI models, and other materials provided by ballcoach are our property (or our licensors'). You may not copy, modify, or distribute them without permission.

6. Disclaimers

Please read this section carefully.

• No guarantees: ballcoach provides training guidance and insights, but we cannot guarantee specific performance improvements or outcomes.
• Not medical advice: Our recommendations are for general training purposes only. If you have health concerns, injuries, or medical conditions, consult a doctor or qualified professional before following any advice.
• AI limitations: While our AI is trained to provide helpful coaching, it may occasionally give incomplete or inaccurate information. Use your judgment and common sense.
• "As-is" service: We provide the Service as-is, without warranties of any kind, express or implied.

7. Limitation of liability

To the fullest extent permitted by law, ballcoach and its team shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. This includes (but is not limited to) injuries, performance issues, or loss of data.

Our total liability for any claim related to the Service is limited to the amount you paid us in the past 12 months (or €100, whichever is greater).

8. Termination

You may stop using ballcoach and delete your account at any time. We may suspend or terminate your access if you violate these terms or for any other reason at our discretion.

Upon termination, your right to use the Service ends immediately. We may retain some data as described in our Privacy Policy.

9. Changes to these terms

We may update these Terms of Service from time to time. If we make significant changes, we'll notify you via email or through the app. Continued use after changes means you accept the new terms.

10. Subscriptions & payments

10.1 Subscription plans

ballcoach may offer various subscription plans with different features and pricing. All subscription fees are charged through:

• Apple App Store (for iOS users)
• Google Play Store (for Android users)

We do not process payments directly. All billing is handled by Apple or Google according to their respective payment terms. We use RevenueCat to securely manage subscriptions, verify purchases, and ensure you have access to premium features across your devices.

10.2 Auto-renewal

Subscriptions automatically renew unless you cancel at least 24 hours before the end of your current billing period.

• You will be charged for renewal within 24 hours before your current period ends
• Renewal charges will be at the then-current subscription price
• We will notify you of any price changes in advance

10.3 Cancellation

You can cancel your subscription at any time:

• iOS: Settings → [Your Name] → Subscriptions → ballcoach → Cancel Subscription
• Android: Google Play Store → Menu → Subscriptions → ballcoach → Cancel

Cancellation takes effect at the end of your current billing period. You will retain access to premium features until then.

10.4 Refunds

Refund policies are determined by Apple and Google, not by ballcoach:

• To request a refund for iOS purchases, contact Apple Support
• To request a refund for Android purchases, contact Google Play Support
• We cannot process refunds directly

Generally, refunds are not provided for partial subscription periods. Please review Apple's and Google's refund policies before subscribing.

10.5 Free trials

We may offer free trial periods for new subscribers. If you sign up for a free trial:

• You must provide valid payment information
• You will be automatically charged when the trial ends unless you cancel
• Only one free trial per user/account
• We reserve the right to determine trial eligibility

11. App Store specific terms

11.1 Apple App Store

If you downloaded ballcoach from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and ballcoach only, not with Apple
• Apple has no obligation to provide support or maintenance services
• Apple is not responsible for addressing claims relating to the App or your use of it
• Apple is not responsible for investigation, defense, settlement, or discharge of any third-party claim that the App infringes intellectual property rights
• You must comply with applicable third-party terms when using the App
• Apple and its subsidiaries are third-party beneficiaries of these Terms

11.2 Google Play Store

If you downloaded ballcoach from Google Play, you must comply with Google Play's Terms of Service.

11.3 License to use the app

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the ballcoach App on your personal mobile device solely for your personal, non-commercial use.

This license does not permit you to make the App available on any network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute, or sublicense the App.

12. Updates & modifications

We may release updates, enhancements, or new features for the App from time to time. These may be automatically downloaded and installed on your device.

Updates may include:

• Bug fixes and performance improvements
• New features and functionality
• Security updates
• Changes required for compatibility with new operating systems

You agree to accept such updates and understand that some features may not function properly without the latest version. You may need to update third-party software (iOS/Android) to continue using the App.

13. Device permissions

ballcoach may request access to certain features and data on your device, including:

• Notifications: To send training reminders and updates
• Microphone: For voice chat with the AI coach (optional)
• Apple Health / Google Fit: To sync fitness and training data (optional)
• Storage: To cache data and enable offline features

You can manage these permissions in your device settings at any time. Some features may not function properly if you deny certain permissions.

14. Geographic restrictions

ballcoach is available worldwide, but certain features or content may be restricted based on your location due to legal or regulatory requirements.

You are responsible for complying with local laws and regulations when using the App. If the App is prohibited in your jurisdiction, you may not download or use it.

15. Governing law & disputes

15.1 Governing law

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

15.2 Dispute resolution

In the event of any dispute arising from these Terms or your use of ballcoach, you agree to first attempt to resolve the dispute informally by contacting us at legal@ballcoachai.com.

If we cannot resolve the dispute within 30 days, you agree that any legal action or proceeding will be brought exclusively in the courts located in Spain, and you consent to the jurisdiction of such courts.

15.3 Exceptions

Nothing in these Terms affects your statutory rights as a consumer. If you're a consumer in the EU, you may have additional rights under EU law that cannot be waived by contract.

16. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ballcoach regarding your use of the App and supersede all prior agreements and understandings, whether written or oral.
